| Player?s pact retains onerous provisions
THE Team Pilipinas Player?s Contract distributed to the members of the national basketball pool handled by Serbian coach Rajko Toroman retains some of the onerous provisions of the offer sheet previously given the players by Samahang Basketbol ng Pilipinas executive director Noli Eala. The offer sheets which become an integral part of a subsequent contract or agreement in basketball did not contain any provision whereby a player would be compensated in case the SBP defaults in its monetary or other obligations. But the new contracts include such a provision subject to certain specific conditions. In the eight-page contract handed out after practice last Tuesday, Section 9.2 states that ?the player has no right to the early termination? of the agreement with the exceptions cited in Section 9.1. They include default by the SBP in payments to the player covered by the agreement or in the event of failure to perform ?any other material obligation that it has agreed to perform.? But the player will be required to notify the SBP about the alleged default or alleged failure in writing and should they not be remedied by the SBP within 15 days, the player is entitled to request that the dispute be ?immediately referred to arbitration in accordance with applicable laws.? Section 9.5 of the contract states: ?In the event the SBP terminates the contract for no justifiable or valid reason, the SBP shall compensate the player the amount equivalent to three [3] months compensation as severance pay.?
